- A Missouri jury rejected design-defect, fraud and negligence claims brought against Monsanto by three plaintiffs.
- The verdict follows the US Supreme Court's June ruling and supports Bayer's effort to contain Roundup litigation risk.
- Bayer is pursuing a 7.25 billion US dollar settlement covering other Roundup cases.
Bayer's Monsanto business won a Missouri Roundup trial on Thursday, October 29, in the first case since the US Supreme Court ruled in the company's favor in June. The decision removes one of the most closely watched legal tests for Bayer as it works to reduce the financial and strategic burden of the weedkiller litigation.
According to Morningstar, a Missouri Circuit Court jury rejected design-defect, fraud and negligence claims brought by three plaintiffs. The verdict follows the Supreme Court's ruling on failure-to-warn claims and gives Bayer another legal result it can point to while defending its glyphosate-based herbicides.
Settlement remains the larger test
The trial win does not end Bayer's wider Roundup exposure. The company is pursuing a 7.25 billion US dollar settlement covering other claims, while continuing to defend cases that remain outside the proposed agreement. Bayer said it would continue to support the safety of its herbicides and defend its products in remaining litigation.
For investors, the verdict is relevant because litigation has weighed on Bayer since its acquisition of Monsanto in 2018. A series of favorable legal outcomes could improve the visibility of that risk, but the proposed settlement and unresolved cases remain material variables for the group's capital allocation and earnings outlook.
