- The case adds a litigation risk to Essity's recently expanded feminine care business.
Essity is facing a new legal risk in its North American feminine care business after hundreds of Los Angeles County residents accused the makers of Carefree panty liners of violating California's PFAS restrictions. Manufacturing Dive reported that court documents were filed on October 9, 2026, in the Superior Court of Los Angeles County.
The plaintiffs allege that Carefree products were intentionally made with perfluorooctanoic acid, or PFOA, a chemical in the PFAS group. They also accuse Essity, Edgewell and Johnson & Johnson of manufacturing and distributing the products after California's ban on the manufacture, sale and distribution of menstrual products intentionally made with PFAS took effect on January 1, 2025. Gelson's Markets is also named in the case over the alleged sale of the products.
Claims Remain Unproven In Court
The lawsuit cites an independent laboratory test from 2024 that allegedly found PFOA in one or more of five Carefree product layers. The filing claims repeated use caused a range of health problems and alleges that the companies failed to disclose the chemical or provide warnings. Those allegations have not been established by a court.
Essity spokesperson Amy Bellcourt said Carefree stands behind its products and that the company does not intentionally add PFAS chemicals to them. She said PFAS are not an ingredient used in making Carefree products, added that ingredients are printed on the packaging and said Essity intends to respond vigorously to the claims.
Essity acquired Edgewell's North American feminine care business in February 2026, bringing Carefree and other brands into its portfolio. The litigation therefore puts attention on product compliance and potential legal costs as the group integrates the business. The case is an allegation, not a finding of liability, but it creates a fresh risk for the unit's reputation and operating outlook.
