BioNTech’s oncology push meets a widening patent fight

BioNTech’s transformation from vaccine champion to cancer company is unfolding on two fronts at once. While management is betting on a long pipeline of oncology data, the group is also facing a new legal front that stretches well beyond the US.

On Thursday, Arbutus Biopharma and its licensing partner Genevant filed three new lawsuits against BioNTech and Pfizer in Canada and before the Unified Patent Court in Europe. The cases centre on lipid-nanoparticle technology, or LNP, which is used to deliver the mRNA active ingredients in the Covid vaccine to cells. The plaintiffs say the companies infringed protected patents and are seeking both damages and permanent sales bans for the affected vaccines.

The European cases cover business in Germany, France, Italy and Spain. The Canadian action is being heard in the Federal Court of Canada. Until now, the dispute had played mainly in front of a US federal court in New Jersey; the latest filings turn it into a genuinely global patent battle.

At the same time, BioNTech is trying to keep investors focused on its oncology roadmap. The company’s key candidate is Pumitamig, also known as BNT327, which it is developing with Bristol Myers Squibb. BioNTech has framed 2026 as a catalyst-heavy year, with six data packages from late-stage studies due across immunomodulators, antibody-drug conjugates and mRNA cancer therapies.

So far, though, none of those readouts has come in the form of final, registration-enabling phase 3 results. The data published to date have all been described as interim analyses or early-stage findings. That distinction matters: the company still has to turn encouraging signals into hard evidence.

Recent study updates have at least kept the pipeline story alive. At the ASCO congress in 2026, an interim analysis from the global phase 2/3 ROSETTA Lung-02 trial showed encouraging anti-tumour activity for Pumitamig in combination with chemotherapy in previously untreated patients with non-small cell lung cancer across all PD-L1 expression levels. Management says this is already the third global dataset to deliver consistently positive signals for the Pumitamig-plus-chemotherapy approach, following earlier data in small-cell lung cancer and triple-negative breast cancer.

The wider development plan is still ambitious. BioNTech says it wants at least 17 late-stage data packages by 2030 and beyond, forming the basis for multiple potential product launches as it builds out a broad oncology business. The company has also said that more than 25 phase 2 and phase 3 cancer studies are currently under way, and that six additional phase 3 trials are scheduled to start in 2026, which would bring the total to 15.

That strategy is being pursued alongside a significant restructuring. In early May, BioNTech announced plans to cut as many as 1,860 jobs. Sites in Idar-Oberstein, Marburg and TĂĽbingen, as well as a plant in Singapore, are affected. The company is also considering partial or complete sales of those facilities, with management targeting annual savings of around EUR 500 million from 2029. The capital released would be redirected into the expanding oncology pipeline, including work at the former CureVac headquarters in TĂĽbingen.

The balance sheet gives BioNTech some room to manoeuvre. At the start of 2026, it held about EUR 16.8 billion in cash, cash equivalents and securities, a cushion large enough to absorb both litigation costs and the expensive research phase ahead.

The stock has spent months in a holding pattern as those two narratives collide. On Thursday it closed at EUR 79.45, almost 25 percent below the January high of EUR 105.80. Year to date, the share price is down 3.7 percent. The RSI stands at 46.6, signalling a neutral market mood. BioNTech is trading just above its 50-day average of EUR 79.20, but still 6.47 percent below the 200-day average of EUR 84.95.

A second set of market measures paints a similarly cautious picture. The shares were quoted at EUR 80.10, with the 50-day average at EUR 79.21 and the 200-day line at EUR 84.95. The RSI in that reading was 48.8. BioNTech also stands 17.19 percent above its year low of EUR 68.35, while the annualised 30-day volatility of 27.68 percent shows how sharply sentiment can swing on each new data release.

Analysts remain split between patience and proof. The average price target of EUR 106.20 implies upside of around 32.6 percent, suggesting that many still see room for the pipeline narrative to play out. But that view depends on whether the upcoming readouts move beyond “encouraging” and into something more concrete.

For now, BioNTech has to manage both the courtroom and the clinic. The patent disputes are expanding abroad, while the oncology programme is still waiting for the kind of late-stage data that can justify the company’s multibillion-euro pivot.
