Germany's Federal Labour Court (BAG) has substantially widened job protection for parents in a ruling delivered on 18 June 2026. The key change: the protective period under the Federal Parental Allowance and Parental Leave Act (BEEG) resets before each individual leave segment — even when several segments are applied for together.

The shield takes effect eight weeks before a parental leave segment starts and lasts until the child turns three. For periods between a child's third and eighth birthday, the notice-free zone extends to 14 weeks. Crucially, the protection applies irrespective of company size or probationary period; any dismissal without prior approval from the competent state authority is void. Employees who believe they have been dismissed unlawfully must file a lawsuit within three weeks.

Breastfeeding Protection Tied to Concrete Hazards

Nursing mothers are entitled to paid breastfeeding breaks. However, a blanket ban on working is subject to strict conditions. It only applies when a specific risk to breast milk exists — from chemicals or hazardous substances, for example. Occupational stress or exposure to viruses, such as teachers routinely face, does not, under current law, justify a work prohibition. Employers must carry out risk assessments and, where warranted, issue work bans. Wage replacement costs are reimbursed through the U2 equalisation scheme.

Holiday Entitlement Does Not Expire

The Hamm Regional Labour Court clarified on 11 September 2025 that annual leave does not lapse during maternity protection or parental leave — not even extra contractual holiday. Instead, entitlement is deferred to the leave year following the end of parental leave. Employers can, however, reduce holiday: for each full calendar month of parental leave, one-twelfth may be deducted, provided the employer makes an explicit written declaration to the employee.

Planned Parental Allowance Cuts Spark Warning

The federal government intends deep cuts to parental allowance from 2027. The drawdown period would shrink from 14 to 12 months. The full 12 months are available only if each parent takes at least three months. Single parents would be capped at nine months. The aim is to save €500 million annually.

In mid-July, Germany's Anti-Discrimination Commissioner, Ferda Ataman, warned the changes would likely increase discrimination. She called for "family care" to be added as a protected ground in the General Equal Treatment Act (AGG). She noted that fathers in particular are reporting negative experiences when taking family-related leave.

Tighter Rules for Basic-Security Recipients

Since 1 July 2026, stricter conditions apply to parents receiving basic income support. The age threshold for the so-called "care protection" fell from the child's third birthday to the 14th month of life. From the 15th month onward, taking up work is considered reasonable — provided a suitable childcare place is actually available. A mere legal right to a nursery place does not suffice.

Further Changes on the Horizon

Before the end of 2026, lawmakers are expected to pass a requirement to present a medical certificate from the first day of sick leave. Employment contracts will soon be permissible in text form rather than the current written form. The statutory minimum wage rises to €13.90 in 2026 and to €14.60 in 2027.
