German Disability Benefits Reform: New Rules Reshape Workplace Rights and Support

Caution on Reassessments
An indefinite severe disability ID card offers no guarantee of permanence. The pension office can initiate a reassessment at any time if evidence suggests improvement in the person's health. The burden of proof lies with the authority. Individuals summoned for a hearing should submit current medical findings to prevent their disability rating from being downgraded—a particularly critical moment just before retirement age.
Parkinson's Recognition as Occupational Disease
A significant clarification now allows Parkinson's disease to be recognized as an occupational illness under certain conditions—specifically, when exposure to pesticides involved at least 100 application days. This opens additional pension options for affected individuals, including reduced-earnings capacity pensions or early retirement for severely disabled people.
Workshop Pay Debate Intensifies
The wage system in workshops for people with disabilities faces a potential legal shake-up. An employee has filed a lawsuit at the MĂĽnster Labor Court demanding payment of the statutory minimum wage. A victory could fundamentally upend the current compensation structure. The Westphalia-Lippe Regional Association (LWL) has so far rejected the claim.
While the legal battle continues, individual states are investing in modernization. Bavaria is contributing roughly €1.5 million to upgrade inclusive workshops in Schwabmünchen, aiming to bring 168 jobs up to contemporary standards and secure participation in working life.
