German Employers Face New Transparency Rules on Bonuses After Landmark 2026 Court Ruling

Time-Tracking Rules Remain Strict — But Don’t Shift the Burden of Proof
Accurate pay starts with accurate hours. The European Court of Justice (ECJ) mandated in 2019 that member states require employers to install reliable time-recording systems. Germany’s BAG fleshed out that obligation on September 13, 2022, ruling that companies must log the start and end of each employee’s daily work.
Yet recording time does not automatically alter who bears the burden of proof in overtime disputes. In a separate decision on May 4, 2022, the BAG confirmed that workers still must demonstrate that overtime was either ordered or tolerated by their employer.
Above-Tariff Pay and Variable Compensation: What Has Changed
For salaries exceeding collective-bargaining agreements, established case law remains intact. Back in June 2002, the BAG ruled that employers are not required to automatically raise above-tariff components when the base tariff increases — provided the new tariff wage does not exceed the previous effective salary.
Variable pay, however, now faces tighter scrutiny. The April 2026 ruling makes clear that arbitrarily switching between target agreements and unilateral target-setting is not permissible. Companies must communicate bonus-relevant corporate objectives in a timely manner, not at the last minute.
Parental Leave, Vacation, and Mini-Jobs
Variable payments can be reduced proportionally during parental leave, according to the Hamm State Labor Court, as long as those payments are tied to actual work performed.
Mini-jobs — low-wage, part-time positions — are on the verge of structural reform. The federal government plans to preserve them primarily for students while integrating them more deeply into the pension insurance system. Currently, the earnings threshold stands at €603 per month, based on a minimum wage of €13.90 per hour.
New Pension Values and Missed Deadlines
On July 1, 2026, pensions rose by 4.24 percent, bringing the current pension value to €42.52. On the same date, the new basic income support replaced the former citizen’s benefit (Bürgergeld).
Germany has been in default since June 7, 2026, on implementing the EU Pay Transparency Directive. For cross-border workers, the ECJ confirmed on December 11, 2025, that days worked in third countries also count when assessing activity in the home state.
Starting January 1, 2027, employees in 15 of Germany’s 16 federal states will be entitled to educational leave. The sole exception is Bavaria. Employers must continue paying wages during such leave, though course and travel costs are typically borne by the worker.
