A cascade of regulatory updates stretching from money laundering to pesticide handling is forcing German employers to overhaul their training and documentation systems or risk penalties that can hit five million euros. The common thread running through every new requirement: the workplace risk assessment mandated under Section 5 of the Occupational Safety and Health Act.

Legal experts at the Information Service for Occupational Safety and Environmental Protection (IFDAU) stress that no employee instruction is legally sound without first completing a formal hazard evaluation. That evaluation follows a five-step sequence: assess the risks, define protective measures, build those measures into training, verify the training's effectiveness, and update everything on a regular cycle. The employer carries overall responsibility, backed by the company's safety specialist.

The stakes are highest in the anti-money laundering arena. Since February 2025, the Federal Financial Supervisory Authority (BaFin) has enforced new interpretative guidelines known as AuA 3.0, while an EU anti-money laundering package from June 2024 introduced mandatory annual staff instruction and airtight documentation. Fines for non-compliance can reach five million euros or ten percent of total annual turnover. Companies must also adapt to the new EU Anti-Money Laundering Authority (AMLA) headquartered in Frankfurt by July 2027. Not surprisingly, many businesses are switching to digital licenses that embed knowledge checks and automatic record-keeping.

Changes are also coming to dangerous goods transport. The Duisburg Chamber of Industry and Commerce (IHK) clarified the rules for digital driver training under the ADR 2027, which takes effect in January 2027. A hybrid model mixing classroom and online sessions will not be permitted. For fully digital courses, a camera-based identity check at the start of each unit is mandatory, plus separate approval from the responsible IHK.

Pesticide handling offers a rare reprieve — but not a reason to delay. The Bundesrat extended the deadline for the rodenticide competency certificate to July 28, 2030. However, specialists advise obtaining the qualification early because the planned new Technical Rule for Hazardous Substances (TRGS 541) is expected to tighten requirements. The corresponding two-day training course remains valid for six years.

Two other hot-button issues underscore why precise instruction matters. The European Court of Justice ruled on October 9, 2025 (Case C-110/24) that employer-organized shuttle trips from a depot to a work site count as full working time. Since January 1, 2026, the statutory minimum wage sits at 13.90 euros. If unpaid travel time pushes effective pay below that threshold, employees can claim back wages with a three-year statute of limitations.

Heat protection is emerging as a facility-management priority. Companies now need specific heat-protection plans, temperature monitoring, and clear ventilation protocols, especially for vulnerable groups. Again, the statutory risk assessment serves as the legal foundation for any technical or organizational adjustments.
