German High Court Closes Loophole on Cancel Buttons â No More âPause Insteadâ Offers for Businesses

Companies offering online subscriptions, memberships, or any recurring contracts must now strip their confirmation pages of all distracting prompts, following a landmark ruling by Germanyâs Federal Court of Justice (BGH) on July 16 (Case No. I ZR 200/25). The decision targets a common practice: urging customers to pause or switch plans just as they try to cancel.
The court sided with the Federation of German Consumer Organisations (Verbraucherzentrale), which had sued the fitness chain FitX. On FitXâs cancellation page, users saw a prominent button offering to put their membership on hold instead of terminating it. The BGH ruled that such alternatives violate Section 312k of the German Civil Code (BGB), which the judges said provides an exhaustive regulation for online termination of continuing obligations.
âThe confirmation page may only contain the legally required information and the confirmation button,â the ruling states. No pause offers, no tariff switches, no advertising. Even buttons labelled misleadinglyâsuch as âFind contractââare now illegal.
The verdict overturns a September 2025 decision by the Higher Regional Court of DĂŒsseldorf, which had viewed the alternative options as permissible factual information. The BGH disagreed emphatically, stressing that the lawâs purpose is to enable cancellations without obstacles, distractions, or manipulation.
This applies to all businesses that conclude recurring contracts online with consumers. Violations risk warnings and fines. FitX has already adjusted its cancellation page, a spokesperson confirmed.
The case is part of a series of rulings tightening online cancellation rules. In 2023, the Munich I Regional Court banned a login requirement at streaming service WOW and a hidden cancel button at Sky.
Ramona Pop, chairwoman of the Verbraucherzentrale Bundesverband, welcomed the judgment. Consumers must be able to end contracts online without distraction, detours, or technical tricks, she said.
The ruling covers all recurring obligations in e-commerceânot just gym memberships. Legal experts advise consumers who cancel online to save the confirmation page as evidence of the transaction.
