German Jobcenters Must Now Push Rehab Options as Employer Reintegration Duties Expand

From July 2026, jobcenters must inform benefit recipients with health issues about rehab. New partial sick leave from 2028 and potential labour reforms reshape absence management.

Since 1 July 2026, Germany’s jobcenters have been legally required to inform benefit recipients with health limitations about rehabilitation and prevention programmes. The reform follows an IAB study showing that 44.5 per cent of working-age Grundsicherung (basic income support) claimants suffer from health problems. There is no obligation to undergo therapy, and sanctions for refusing treatment are explicitly prohibited.

The change adds a layer to an already shifting landscape of workplace reintegration rules. From 1 January 2028, a new partial sick-leave regulation under §44c SGB V will allow employees to return to work at 25, 50 or 75 per cent of their usual hours. Unlike the existing Hamburg Model, this counts as regular employment with proportional pay. Employer consent remains mandatory for each step-up.

Companies that fail to manage absence properly face growing legal exposure. Experts are debating a broader labour-law reform that could introduce a doctor’s certificate requirement from the first day of sickness. Unlimited fixed-term contracts (sachgrundlose Befristungen) might be extended to 48 months with up to six renewals – a change that, according to labour lawyers, raises the bar for legally watertight absence?management processes.

Managing absence and legal risk starts with solid health-and-safety documentation. Yet many UK firms still lack the ready-to-use risk assessments and compliance checklists that regulators expect. Understanding the Betriebliches Eingliederungsmanagement (BEM) – the company reintegration procedure – is becoming critical. A long illness does not automatically justify dismissal. Many employers wait out the first six weeks of continued wage payment because after that point salary costs drop off. But a flawed or omitted BEM process can weaken a company’s position in court. Severance payments usually arise only from a settlement; workers who sign a termination agreement on their own may harm their bargaining power.

Prevention experts argue that corporate health management (BGM) needs three stable pillars: occupational safety, health promotion and behavioural prevention. A networking event in early July stressed that leadership must be actively involved. A social enterprise in Berlin was recognised in mid-July for its inclusion efforts, offering permanent contracts and genuine participation.

Altersteilzeit (partial retirement) is also up for revision. The Alterssicherungskommission recommends scrapping the block model and retaining the equal?distribution model, while raising the entry age from 55 to 58. Time?value accounts (Zeitwertkonten) are seen as a flexible alternative, though they require tax adjustments.

Practical support is available. Companies can use free counselling from organisations such as the IHK DĂĽsseldorf. The Deutsche Rentenversicherung Nord runs a business service covering Hamburg, Mecklenburg-Vorpommern and Schleswig-Holstein, with advice on BEM, BGM and prevention programmes.
