German companies could soon face a flood of legal claims after the government admitted it will miss the June 7, 2026 deadline to implement the EU Pay Transparency Directive. The federal family ministry now expects national legislation no earlier than early 2027.

Labour law expert Heide Pfarr warned that the delay leaves the private sector exposed. Because the transposition period is expiring, certain EU rules will take direct legal effect for public employers and state-owned enterprises as early as June 8. "Legal action is almost certain to spike," Pfarr said. She accused business-friendly advisers of blocking proposals that would have kept bureaucracy low.

The 2023 directive aims to shrink the gender pay gap. In Germany, that gap stood at 16 percent in 2025 – or 6 percent when adjusted for factors like qualifications and hours.

Family Minister Karin Prien (CDU) called the EU requirements excessively bureaucratic. She announced talks with European partners to push for changes at the European Commission. "We are obliged to implement, but we want a solution that burdens the economy less," Prien said.

The directive’s critics go further. Within the conservative Union parliamentary group, MPs Andreas Lenz and Anne König are demanding the directive be scrapped entirely. They argue the rules are impractical and offer no measurable benefit for gender equality. The Social Democrats (SPD) counter that the Union is deliberately stalling the project.

Under the EU rules, employers must grant workers detailed information about pay structures. Companies also have to publish reports on their salary systems every three years. The goal is to reveal and eliminate gender-based wage discrimination through transparency.

Separately, and unrelated to the pay transparency dispute, the federal cabinet approved amendments to the General Equal Treatment Act (AGG) in early May. The deadline for filing discrimination claims will double from two to four months. Protection against sexual harassment is being extended to the housing rental market. A new independent arbitration body is also planned, housed within the Federal Anti-Discrimination Agency.
