Germany Wraps Up Fuel Subsidy as Legal Heat Mounts Over Heating Law and Gas Strains

The temporary fuel discount that slashed diesel prices by 16.7 cents per litre ends today, with a study from the Ifo Institute showing only about 12 cents of that cut actually reached drivers. A legal opinion prepared by the law firm Freshfields for the energy service provider Enpal argues that the building modernisation law—Gesetz zur Gebäudemodernisierung—violates the German constitution on several counts. The brief cites an infringement of the fundamental right to intertemporal freedom protection, referencing the Federal Constitutional Court’s landmark 2021 climate ruling. It also claims the law conflicts with the EU’s building directive, which demands a zero-emission building stock by 2050.
The Economy Ministry, led by Katherina Reiche, rejects the allegations. Officials say constitutional compliance was thoroughly reviewed and that EU requirements have been transposed one-to-one. The much-debated 65-percent rule requiring renewables for new heating systems, they note, was not explicitly mandated by Brussels.

In basic supply contracts, gas costs have fallen an average of 4.1 percent to €2,687 for an annual consumption of 20,000 kilowatt-hours, benefiting about 3.7 million households. However, new customers are paying 10.5 percent more—12.3 cents per kilowatt-hour. Wholesale prices, which surged from €30 to €66 per megawatt-hour, have since stabilised at roughly €41.
The importance of workplace safety in high-risk environments was underscored by an incident in Königsbrunn, where extreme sunlight caused a gas tank on a company site to overheat, triggering a leak that forced around 70 residents to evacuate. Fire crews cooled the tank and a specialist firm released the gas in a controlled manner.
Manufacturers are responding with advanced materials.
