Corporal Darren Neilson, 31, and Corporal Matthew Hatfield, 27, died when a blast occurred during a training exercise involving a Challenger 2 tank. Two additional personnel suffered injuries in the explosion.
The HSE investigation into the circumstances of the failure at the firing range concluded that formal enforcement action was warranted.

Why a censure rather than a prosecution
Under UK law, the MoD benefits from Crown immunity, meaning it cannot face criminal prosecution for health and safety breaches. A Crown Censure is the maximum sanction the HSE can impose on a government body when its failings would otherwise have justified a criminal prosecution.
While the MoD faces this administrative penalty, the private joint venture Rheinmetall BAE Systems Land Ltd will be prosecuted in court. The legal proceedings will examine the company's responsibilities regarding the safety protocols and equipment involved in the fatal event.
A formal hearing is expected to be scheduled to conclude the Crown Censure process against the MoD. The HSE has not yet released specific dates for the upcoming court proceedings against the defence contractor.
