SK Hynix shares are under heavy selling pressure, with the stock showing a daily move of -9.5%. The retreat is not the product of a fresh company announcement. Instead, it comes amid a sector-wide selloff in South Korean semiconductor names, triggered by media reports that investors fear tighter rules on AI data centers following the US midterm elections.

The distinction matters. What the market is pricing today is a worry about possible consequences of the election outcome, not evidence that stricter regulation has already been enacted or that specific orders at SK Hynix have been cancelled. The feared fallout runs from delayed construction projects to postponed chip orders—a potential shift in future demand rather than a confirmed deterioration.

A Record Quarter as the Operating Yardstick

Against that nervous backdrop, the company's reported results tell a different story. On October 28, SK Hynix posted revenue of 104.6155 trillion won for the third quarter of 2026. Operating profit came in at 83.3338 trillion won, with net profit of 39.7756 trillion won.

According to Reuters, that marks a record quarterly operating profit. Demand for AI infrastructure had driven memory prices higher—which explains why the data center outlook carries so much weight in valuing the company: it was already a driver of the reported business performance. Operating profit rose more than sevenfold year-on-year and beat the 76.7 trillion won expected by LSEG SmartEstimate.

Should investors sell immediately? Or is it worth buying SK Hynix?

Contracts Covering 2027–2028

Beyond the completed quarter, SK Hynix disclosed long-term capacity agreements on October 28. Per company statements, these arrangements cover more than 50% of production capacity for 2027–2028. That contractual lock-in is more important for putting the share price decline in perspective than the daily move alone: a portion of future capacity is already spoken for.

The contracts do not amount to full protection for the business, however. They cover only part of production capacity, while the market's concerns center on the pace of further investment in AI infrastructure. Contractual commitments and uncertainty about additional demand can therefore coexist.

Capital Returns on the Horizon

For 2026, SK Hynix also held out the prospect of capital returns to shareholders of roughly 100 trillion won. That figure is set to include cash dividends of at least 30 trillion won. At least 60 trillion won was earmarked for share buybacks and the cancellation of shares. Announcement and execution remain two separate things, but the plans add another counterweight to the regulatory anxiety.

Two Time Horizons, Not a Contradiction

Investors are thus weighing two different sets of evidence. The record profit demonstrates the strength of AI demand to date; the long-term agreements extend beyond the quarter just closed. Neither eliminates the risk of a slower build-out of AI infrastructure, and high reported earnings do not rule out risks to future investment and orders.

Today's decline and the quarterly figures need not conflict—they concern different time horizons. The key question is whether the political fears actually translate into delays in construction projects and orders. What can be said with certainty is that the reported trigger is regulatory concern, not a newly announced cut to the company's targets.
